Isn’t the idea of “Gay’s can only have civil unions” a violation of the idea “equal protection under the law”?

Because theoretically straight couples can choose, right? Straight couple can choose between having a marriage or having a Civil Union.

And even if straight couples were limited to marriage only, how can we create a system that does not conflict with Brown vs Board of Education.

You’re absolutely right. Separate but equal is never equal.
