Why should basic human rights(gay marriage) be subject to popular vote?
Why should “the people” be allowed to determine if a gays should be allowed to get married or not?
Marriage is not considered a right; it’s a voluntary union that happens to be recognized by the government. (Some believe that marriage is a religious institution; others merely a forging of ties to secure property rights, which has usually been the case throughout much of history. This is best left for another discussion.)
However, I will agree that when it comes to equal protection under the law, popular sentiment should never dictate which people should enjoy which rights. Otherwise, we would end up creating a majoritarian society with a second-class citizenry, which is quite contrary to a republican form of government. “Majority rule” only works with the protection of minority rights.
